Terms & Conditions

Welcome to Atlas Boy. These Terms & Conditions (“Terms”) govern your use of atlasboy.studio (the “Site”) and any purchase you make through it. By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About us

The Site is operated by Yes Be Fab LLC, DBA Atlas Boy, registered in New York, USA, with contact address 228 Park Ave S, PMB 982065, New York, NY 10003 (“Atlas Boy,” “we,” “us”). Questions about these Terms: hello@atlasboy.studio.

2. Products

We make small-run swimwear and related goods. We work to display our products accurately, but colors may render differently on different screens, and minor variations between the photography and the piece you receive do not constitute a defect. All sizes are as stated in our size chart. Products are for personal, non-commercial use; we may limit quantities per order or per customer.

3. Orders & acceptance

Your order is an offer to purchase. We accept it when we send a shipping confirmation — an order confirmation email acknowledges receipt but does not constitute acceptance. We may refuse or cancel any order at our discretion, including for suspected fraud, pricing or stock errors, or shipping restrictions; if payment was taken, it will be refunded in full.

4. Pre-orders

Pre-order items are charged at the time of order and ship by the estimated date shown on the product page (currently August 2026). Estimated dates are good-faith estimates, not guarantees; we will notify you of material delays, and you may cancel a pre-order for a full refund at any time before dispatch.

5. Pricing & payment

All prices are in US dollars and exclude taxes and duties unless stated otherwise at checkout. Sales tax is applied at checkout where required. For international orders, you are the importer of record and responsible for any customs duties, import taxes, and brokerage fees. We may change prices at any time; changes do not affect orders already accepted. In the event of an obvious pricing error, we may cancel the order and refund you.

6. Shipping & risk

Shipping methods, costs, and any free-shipping thresholds are shown at checkout. Delivery dates are estimates. Risk of loss passes to you on delivery to the address you provided; please make sure your address is correct — we are not responsible for orders shipped to an incorrectly entered address. Title passes on our receipt of full payment.

7. Returns

Returns and exchanges are governed by our Return & Exchange Policy, which forms part of these Terms and provides for US returns and size exchanges within 7 days of delivery (subject to hygiene conditions and a flat return-shipping cost), remedies for faulty or incorrect items, and the EU/UK statutory right of withdrawal. Nothing in these Terms limits any non-waivable statutory rights you hold in your jurisdiction, including rights concerning defective goods.

8. Gift cards & store credit

Gift cards and store credit are not redeemable for cash, are non-refundable except where required by law, and may not be resold.

9. Discount codes & promotions

Promotional codes are single-use per customer unless stated otherwise, cannot be combined, have no cash value, and may be withdrawn at any time. We may cancel orders that abuse promotional terms.

10. Your account & conduct

You are responsible for the accuracy of the information you provide and for keeping any account credentials secure. You agree not to use the Site unlawfully, to interfere with its operation, to scrape or copy its content for commercial use, or to misrepresent your identity.

11. Intellectual property

All content on the Site — the Atlas Boy name and wordmark, product names (including Pothos, Nostos, Telos, Odós), photography, film, text, and design — is owned by or licensed to Atlas Boy and protected by intellectual-property laws. You may not reproduce or exploit it without our prior written consent. If you tag or share content featuring our products and we ask to repost it, we will credit you; by agreeing, you grant us a non-exclusive license to use that content in our marketing.

12. Newsletter & communications

By subscribing to our newsletter (The Diadromí) you consent to receive it; you can unsubscribe at any time via the link in any email. Transactional emails about your orders are sent regardless of marketing preferences. Our handling of your personal data is described in our Privacy Policy.

13. Warranties & disclaimers

Except as expressly stated (and except for non-waivable statutory warranties), the Site and products are provided “as is.” We do not warrant that the Site will be uninterrupted or error-free. Nothing in these Terms excludes warranties or rights that cannot be excluded under applicable law, including implied warranties of merchantability for defective goods.

14. Limitation of liability

To the fullest extent permitted by law, Atlas Boy’s total liability arising out of any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, or consequential damages. Some jurisdictions do not allow these limitations; in those places, our liability is limited to the minimum extent permitted.

15. Indemnity

You agree to indemnify Atlas Boy against claims arising from your breach of these Terms or misuse of the Site.

16. Governing law & disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in New York County, New York, except where you hold a non-waivable right to bring proceedings in your home jurisdiction (including under EU/UK consumer law).

17. Changes to these Terms

We may update these Terms from time to time; the version in force at the time of your order applies to that order. Continued use of the Site after changes constitutes acceptance.
